ONE YEAR LIMITED WARRANTY


Your new home is protected by a One Year Limited Warranty. This warranty is for material and workmanship. Coverage will begin at the time of closing and continue for one full year. At the conclusion of the warranty period, work will be accomplished on only those items that were documented during the warranty period.

In order to ensure proper communications on warranty matters between the homeowner and the builder, the homeowner shall document and submit to Banyan Homes Inc. a written list of all items to be considered for corrective action.

Material and Workmanship Warranty Guidelines- One Year


The following warranty guidelines are intended to specify the minimum performance standards for construction of homes by Banyan Homes Inc. and set forth the basis for determining the validity of all home buyer's complaints relative to defective materials and workmanship during the applicable warranty period under Banyan Homes Inc.'s Limited Warranty Agreement.

Only the most frequent defects of concern to the home buyer have been enumerated in these guidelines. The structural, mechanical, plumbing, and electrical standards shall be those contained in the Building code, Mechanical-Plumbing Code and Electrical Code of the governmental entity having jurisdiction of and regulating the subject construction. Inspection by governmental jurisdiction will provide evidence of compliance.

To the extent that minimum performance standards for construction have not been enumerated in the guidelines, defects and deficiencies in materials and workmanship will be those recognized under generally accepted standards of the building industry in Pennsylvania which assure quality of materials and workmanship. This general standard shall be used to determine the validity of any buyer's complaints for defects or deficiencies for which a specific standard has not been enumerated herein.

All services and work mentioned refer to the One Year Materials and Workmanship portion of the Limited Warranty Agreement. The selection of a method to repair an item or the decision to replace it will be made by Banyan Homes Inc.

Subcontractors will perform Homeowner work requests only upon instruction from Banyan Homes Inc. This will be in form of a work order to purchase order issued by Banyan Homes Inc.
The subcontractor has 14 days to complete the work. Homeowner delays, inclement weather, and lack of parts may delay this process though.

EMERGENCY SITUATIONS ARE EXCEPTED FROM THIS POLICY. Emergency conditions would include, severe plumbing problems, no heat in cold weather, or any potentially hazardous condition. The Homeowner is provided with manufacturer's literature on consumer products installed in the home. The lack of any such material should be reported to Banyan Homes Inc. so that they may be obtained.

Routine maintenance of the home is the Homeowner's responsibility. This includes familiarizing themselves with recommended procedures for using and maintaining all components of the house. Particularly in regard to landscaping and the protection of foundation and flat concrete. The Homeowner's knowledge and cooperation are vital. Homeowner Hints on maintenance are included in these guidelines. Negligence of normal maintenance items can void the warranty on the item involved.



Warranted Items and Terms



HEATING / AIR CONDITIONING

The heating and cooling system is installed in accordance with local building codes, as well as engineering designs of the particular home. Furnace filter should be changed once each month to insure maximum efficiency and clean service. A clogged filter can slow air flow and cause cold or hot spots in your house.


PLUMBING

All drains and sewer lines should operate freely. Obstruction resulting from construction debris will be corrected by Banyan Homes Inc. Clogged drains during the first 30 days will also be fixed free of charge. Obstructions shown to be the result of Homeowner action will be corrected at Homeowner's expense.

Banyan Homes Inc. will repair leaks in the plumbing system. If a plumbing leak caused by a warranted item results in drywall or floor covering damage, this will be repaired by Banyan Homes Inc.

Many plumbing problems are caused by improper garbage disposal use. Always use plenty of cold running water when running the disposal. Allow the water to run 10-15 seconds after shutting the disposal off.


ELECTRICAL

If electrical outlets, switches, or fixtures do not function as intended, Banyan Homes Inc. will repair or replace them. Any electrical wiring that fails to carry its designed load will be repaired to meet specifications.

Electrical boxes on exterior walls may produce cold air flow through the outlet. This is normal and no action will be taken.


SUB-FLOORING

Some floor squeaks are unavoidable. Banyan Homes Inc. does not warrant against floor squeaks.


DRYWALL

Some slight cracks, nail pops, and /or drywall seams may become visible in walls and ceilings. These occurrences are normally caused by the shrinkage of the wood to which the drywall is attached to.

One time at the end of the warranty period, Banyan Homes Inc. will make needed drywall repairs to cracks exceeding 1/8th inch in width.

The Homeowner will be responsible for any touch-up or repainting that is needed as a result of this service. Such touch-up may not match original paint exactly. Repairs will not be made on flaws which are only visible under particular lighting conditions.

If the drywall repair is the result of plumbing leak or other warranty based repair, Banyan Homes Inc. will assume the cost of repainting the area of drywall.


PAINTING / STAINING (INTERIOR)

Homeowner will receive a sample of each interior paint used for touch-ups. This paint should be stored so as not to be affected by freezing temperatures.

Paint touch-ups are sometimes visible under certain lighting conditions.

Due to wood characteristics, color variations will result when stain is applied. There will be no repair or replacement os such variations.


WOOD TRIM

Minor imperfections may be visible. Banyan Homes Inc. will correct only those serious defects such as, chips, gouges, etc, which are noted before move-in. Separation of wood trim from the adjacent material is a normal result of shrinkage. A small dimple may result where nailed. This is due to wood shrinkage and will not be repaired.


DOORS

Due to normal settling of the home, doors may require adjustment for proper fit. Banyan Homes Inc. will make such adjustments.

Interior doors should not warp in excess of National Woodwork Manufacturers Association Standards ( 3/8 inch, measured diagonally from corner to corner). Banyan Homes Inc. will correct or replace and refinish defective doors to match existing doors as nearly as possible.


HARDWARE

Doorknobs and locks should operate correctly. Some slight adjustment may be needed due to normal shrinkage of the framing.


FLOOR COVERINGS

Although carpet seams will be visible, no gap or fraying is acceptable. Edges of carpet against base moldings and along edges of stairs should be held firmly in place. No metal or other edging material is used when carpet meets another floor covering.

Because of climatic conditions, swelling and/or shrinkage of hardwood floors is common. These conditions are the result of a change in moisture content in the wood and are not warranted. Wood floors will respond noticeably to changes in humidity level in the home, especially in the winter. Wood floors will also dimple ro scratch due to furniture movement, or dropping heavy or sharp objects on them.

Vinyl floor coverings should adhere; lifting or bubbling will be repaired. Seams will occur and are sealed at the time of installation; there should be no gaps or curling at seams. Under certain lighting conditions and glare, seams of the subflooring underneath the vinyl can be seen; this is normal and will not be fixed.

Ceramic tile that is cracked, badly chipped, or loose, noted before move in will be repaired or replaced. Banyan Homes Inc. is not responsible for variations in color or discontinued patterns. New grout may vary in color from the original. Cracks appearing in grouting of ceramic tiles at joints or junctions with other materials are commonly due to normal shrinkage conditions. Banyan Homes Inc. will repair grouting, if necessary, one time during the first year. Any grouting or caulking that is needed after that time is considered Homeowner maintenance.


CABINETS

Cabinets (drawers, doors, etc.) should operate properly under normal use. Doors, drawer fronts, and handles should be level and even. Warped doors or drawer fronts will be corrected if warpage is in excess of 3/8" within any 24" distance. Gaps between cabinets, cabinets and ceilings, or cabinets and walls will be corrected if they are in excess of 3/8", except locations behind appliances.

Readily noticeable variations in wood grain and color are expected in all style selections. Repairs to these will not be made.


COUNTERTOPS

Separations of countertops at walls and where back-splash meets the counter are the result of normal shrinkage of materials. Separations of the wall or at the counter will be repaired one time; this repair is done by caulking and subsequently will be a Homeowner responsibility.


APPLIANCES

Kitchen appliances are warranted directly to you by their manufacturer. For most items this warranty is for one year. Refer to literature on each appliance for details and limitations. Be certain to mail all warranty cards.


FIREPLACE

Fireplaces are not intended to be the sole heat source in the home. The fireplace should function properly when manufacturer's directions are followed. Although extremely high winds can result in downdraft, this condition should be temporary and occasional. Continuous malfunctions should be reported to Banyan Homes Inc. immediately to determine cause and to have the problem fixed.


CONCRETE

To accommodate soil conditions in Pennsylvania, concrete slabs are "floating", i.e., they are not attached to the foundation walls. These are NOT a structural element of your home. The warranty coverage is for one year only.

Movement of the basement slab results in cracking. If such cracks reach 1/4" in width or vertical displacement, Banyan Homes Inc. will patch or repair one time during the warranty year. Subsequently, floor slab maintenance is Homeowner responsibility. Garage slab as well as porch and patio slabs are warranted similarly.

Repeated hosing of concrete for cleaning, animal urine, radiator overflow, fertilizer, failure to shovel snow and ice, ice melting agents, or road salts form vehicles are some of the causes of spalling. Banyan Homes Inc. is not responsible for repair of spalling concrete.


FOUNDATION WALLS

Shrinkage or backfill cracks are not unusual in basement or foundation walls, especially at the corners of the basement windows. Banyan Homes Inc. will repair as needed, cracks which are in excess of 1/8", or any cracks that are permitting water to enter the basement.

Slight dampness may be experienced in foundation walls. Walls that are permitting water to enter basement or standing water in basement should be reported to Banyan Homes Inc. for inspection and action.


DRAINAGE / LANDSCAPING

The final grade is established by engineering and/or excavation department as part of an overall plan for the lot as dictated by topography of the land. The primary concern is drainage away from the house. Due to weather conditions, especially during winter and early spring, it may happen that the final grade has not been established at the time of closing. As soon as conditions permit, grading work will continue. Proper watering and maintenance of the lawn as well as tree, plants, and bushes are the responsibility of the homeowner. In some cases, some of the landscaping items do not survive the transplanting process well and die, they will be replaced at the end of the one year warranty.

Banyan Homes Inc. will fill sunken areas due to settlement once within one year period of completion.




One Year Limited Warranty- Addendum #1


DOORS AND WINDOWS: We will not guarantee against warpage or cracks in solid wooden exterior doors.

Exterior doors will be open to the elements and they will take more abuse, any serve weather will not be covered. Any exterior wooden doors or windows will have a possibility of expansion and contraction.

DRYWALL : We will not be responsible for any drywall repairs in unheated areas such as basement stairways and garages.

FROZEN PIPES: We will not guarantee frozen pipes when interior house temperatures are below 60 degrees.

LACK OF HOT WATER: It is the homeowner's responsibility when selecting any whirlpool other than those specified that the water heater be upgraded to accommodate the whirlpool.

CRACKED TILE/MARBLE: Builder will not be responsible for cracked ceramic tile and /or marble caused by house settlement.

CRACKED TOILET SEATS: Builder will not warrant toilet seats which crack after occupancy.

SCRATCHED FORMICA/BATH TOPS: Builder will no replace or repair countertops of any type which become damaged after occupancy.

CRACKED TRIM/BASEBOARD: Builder will not be responsible for cracking or shrinkage in trim or baseboard if homeowner does not maintain 40% humidity. Dryness will cause excess shrinkage.

HARDWARE FINISH: Builder will not warrant the finish on any interior or exterior hardware.

SHELVING: Builder will not be responsible for any closet and pantry shelving falling down due to the shelving unit being overloaded.
